Employers Must Use Form I-9 Dated 11/14/2016

Posted on: 3/10/17 by James E. Amell, CPA

Beginning Jan. 22, 2017, employers must use the 11/14/2016 N version of Form I-9 Employment Eligibility Verification, to verify the identity and work eligibility of every new employee hired, or for the reverification of expiring employment authorization of current employees (if applicable). This date is found on the lower left hand corner of the form. Prior versions of the form will no longer be valid for use. Employers who fail to use Form I-9 (11/14/2016 N) on or after Jan. 22, 2017 may be subject to all applicable penalties under section 274A of the Immigration and Nationality Act, 8 U.S.C. 1324a, as enforced by U.S. Immigration and Customs Enforcement (ICE).  Following is the web address to find the most current I-9 form. https://www.uscis.gov/node/41230

Employers who hired new employees having employment dates after 11/13/16 and used an old form may complete a new form and attach it to the old.
Retention requirements remain unchanged; completed I-9s must be retained for the later of 3 years from the date the employee began to work or 1 year from the date of termination.  The CIS allows the completed form to be stored in paper or electronic form, but in either case the complete forms must be immediately available for inspection if so requested by representatives of any of the 3 federal agencies that may ask to inspect the forms.
